Terms of Service

By creating an account, accessing, or using Lumia AI, you agree to these Terms, our Privacy Policy, and any other policies expressly incorporated into them.

• You must be at least 13 years old, or the minimum digital-consent age in your jurisdiction.
• You must provide accurate registration information and keep it updated.
• You are responsible for your credentials and activity under your account.

Lumia AI helps users create, organize, study, and share flashcards and related study materials. Certain features rely on AI systems, analytics, storage, and synchronization services.

• Web purchases are generally processed through Paddle as merchant of record.
• Mobile purchases may be processed through Apple, Google, RevenueCat, or another store-billing provider.
• Paid subscriptions renew automatically unless canceled before the next renewal date.
• Prices, limits, taxes, and available plans may change over time.

• Violate law, intellectual-property rights, or the privacy or rights of others.
• Upload malicious, unlawful, abusive, deceptive, or fraudulent content.
• Bypass rate limits, security controls, subscriptions, or usage restrictions.
• Reverse engineer, scrape at scale, resell, benchmark, or build a competing service from Lumia AI except where law clearly allows it.

You retain ownership of the prompts, uploads, flashcards, books, and other content you submit. You grant us a non-exclusive, worldwide, royalty-free license to host, process, transmit, display, and use that content as necessary to provide, secure, maintain, and improve the Service.

• You represent that you have the rights needed to upload and use submitted content.
• We may remove or restrict content that violates these Terms, applicable law, or third-party rights.
• If you make content public or share it with others, you do so at your own risk.

Lumia AI, including its software, interface, branding, models, and underlying technology, is owned by or licensed to us and protected by law. We may add, change, suspend, or discontinue features at any time.

• The Service is provided on an as-is and as-available basis to the fullest extent permitted by law.
• We do not guarantee uninterrupted availability, error-free performance, learning outcomes, or exam results.
• You should keep your own backups of important materials.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or business opportunities related to the Service.

If liability is imposed despite the above, our aggregate liability will not exceed the greater of the amount you paid us for Lumia AI in the previous twelve months or USD $50, except where mandatory law requires otherwise.

• You agree to indemnify us for claims arising from your content, misuse of the Service, or violation of these Terms.
• We may suspend or terminate access if you violate these Terms, create legal or security risk, or fail to pay required fees.
• These Terms are governed by the laws of the Republic of Colombia and disputes will be brought before the competent courts of Bogotá, D.C., unless mandatory law requires otherwise.
